Pozdravljeni!
Your rights
Am I a national of the European Economic Area (EEA)?
You are a national of the EEA if you are a national of one of the following countries.
Austria, Italy
Belgium, Latvia
Cyprus, Liechtenstein
Czech Republic, Lithuania
Denmark, Luxembourg
Estonia, Malta
Finland, Netherlands
France, Norway
Germany, Poland
Greece, Portugal
Hungary, Slovakia
Iceland, Slovenia
Ireland, Spain
Sweden
Iceland, Liechtenstein and Norway are not members of the European Union (EU). However, the European Economic Area Agreement gave nationals of these countries the same rights to enter, live in and work in the United Kingdom as EU citizens.
Although the United Kingdom is also a member of the EEA, in general the information on this page is not relevant to British citizens and their family.
Do I have a right to live in the United Kingdom?
European Community law gives EEA nationals a right to live and work in the United Kingdom. This is called a right of residence.
You have a right of residence in the United Kingdom if you are an EEA national and:
you are working in the United Kingdom; or
you do not work in the United Kingdom but you have enough money to support yourself throughout your stay without help from public funds.
Public funds include Income Support, Housing Benefit and Council Tax Benefit.
Do I need to show my passport or national identity card when I enter the United Kingdom?
Yes, you need to show your passport or national identity card when you enter the United Kingdom. When you arrive at major ports and airports, you should use the separate channel marked ‘EEA/EU’ where it is available. Immigration officers will check your passport or national identity card to make sure that it is valid and belongs to you.
What rights do I have if I want to work in the United Kingdom?
You can:
accept offers of work;
work (whether as an employee, in self-employment or in business);
set up a business;
manage a company; or
set up a local branch of a company.
You do not need a work permit, however you may need to register as a worker under the Workers Registration Scheme.
You should not be discriminated against by your employer because of your nationality in terms of conditions of employment, pay or working conditions.
Can I live in the United Kingdom if I am not working?
You can live in the United Kingdom as a student, as a retired person or if you are not working, as long you have enough money to support yourself throughout your stay without needing help from public funds.

Information about working holidaymakers
These pages explain what the Immigration Rules say about working holidaymakers. They are only a guide and aim to answer the frequently asked questions.
If this page does not answer your questions, please telephone or write to us for further information at the address at the end of this leaflet
What is the working holidaymaker scheme?
The working holidaymaker scheme is an arrangement whereby a person aged between 17 and 30 (inclusive) can come to the United Kingdom for an extended holiday for up to two years, with the intention of taking paid work here as a part of his working holiday.
How do I qualify as a working holidaymaker?
You are eligible for entry clearance as a working holidaymaker if:
· you are a Commonwealth citizen, British Dependent Territories citizen or British Overseas citizen;
· you are aged 17 to 30 (inclusive);
· you want to come to the United Kingdom for an extended holiday, with the intention of taking paid work here as part of your holiday;
· you are single or are married to a person who also qualifies for and plans to take a working holiday at the same time as you;
· you do not have any dependent children who are aged five years or over, or who will be five before you complete your holiday;
· you can support and accommodate yourself without help from public funds;
· you can pay for your onward or return journey; and
· you plan to leave the United Kingdom at the end of your holiday.
You must get entry clearance as a working holidaymaker before you travel to the United Kingdom.
What are public funds?
If you come to live or stay in the United Kingdom, you must be able to support and accommodate yourself without claiming certain state benefits. These are:
· Income Support and Jobseeker’s Allowance (JSA);
· housing and homelessness assistance;
· Housing Benefit and Council Tax Benefit;
· Working Families’ Tax Credit;
· Child Benefit; or
· any disability allowance.
How long can I stay?
You can only stay in the United Kingdom for two years as a working holidaymaker. We will count any time you spend outside the United Kingdom during that period as part of the two years.
What type of work can I do?
There are no restrictions on the type of paid work you can do. You may do any paid work you choose, for as long as you want while you are here, but you should still intend to take a holiday during your stay. (You may also engage in unpaid voluntary work that meets the terms of the National Minimum Wage exemption for voluntary workers.)
How to apply
What is entry clearance?
Entry clearance is a visa or entry clearance certificate that you are given so that you can travel to the United Kingdom. You must apply for entry clearance to the British Embassy, High Commission or other British Diplomatic Mission (known as British Diplomatic Posts) in the country where you live.
You can get advice about which British Diplomatic Posts can issue entry clearance from any British Diplomatic Post abroad.
You can get guidance leaflets and information about visas from UK visas. Please contact:

Application forms: +44(0)20 7008 8308
Fax numbers: +44 (0)20 7008 8359/8361
Can I extend my stay as a working holidaymaker?
You can apply to extend your stay if:
· you entered the United Kingdom with valid United Kingdom entry clearance as a working holidaymaker; and
· an extension of your stay would not take your stay beyond two years from the date you were first given permission to enter.
We will not give you permission to stay as a working holidaymaker if you did not enter the United Kingdom with an entry clearance as a working holidaymaker.
Can I extend my stay as a Work Permit holder?
You can apply to extend your stay as a Work Permit holder if:
· You have been in the United Kingdom for more than 12 months as a working holidaymaker; and
· You meet the work permit criteria in full.
How do I apply for an extension of stay?
You will need to complete an application form. Applications (except those for asylum and work permits or under European Community law) will not be valid unless they are made on the appropriate application form. To apply for further leave to remain as a working holidaymaker, get form FLR(O).
If you are in any doubt as to which form you should use please telephone the Immigration and Nationality Enquiry Bureau on 0870 606 7766. Lines are open from 9am to 4.45pm, Monday to Thursday and from 9am to 4.30pm on Fridays. We are not open at the weekend or on public holidays. At certain times of the day this number gets very busy and you may have to wait a while before your call is answered. Every effort is made, however, to answer calls.
You should send the form to us, by post, before your permission to stay ends. The application form will give you details of all the documents you will need to send with your application and where you should send it. All documents should be originals unless you have a good reason why you cannot produce them with your application. We will not normally accept photocopies.
If you need to travel urgently, you can apply in person at one of our Public Enquiry Offices.

Position for New Member States – Workers Registration Scheme.
The statement by the Home Secretary to Parliament on 23 February announced that workers from the new member states must register with the Home Office.
From 1 May 2004 nationals from New Member States will be free to come to the United Kingdom. Nationals from Malta and Cyprus will have full free movement rights and are not required to obtain a workers registration certificate.
Nationals from the following new member states; Poland, Lithuania, Estonia, Latvia, Slovenia, Slovakia, Hungary and the Czech Republic who find a job in the United Kingdom are required to apply to register with the Home Office under the new ‘Worker Registration Scheme’ as soon as they find work.
Full details on the Worker Registration Scheme are available on the website http://www.workingintheuk.gov.uk/working_in_the_uk/en/homepage/schemes_and_programmes/worker_registration.html.
No ti si posredoval clanek, jaz ti ga bom pa prevedla. Torej drzavljani zgoraj nastetih drzav se morajo, ko najdejo zaposlitev prijaviti v registru v Home Office. Ja in?
In to bo trajalo naslednjih 7 let.
